Since the enactment of the law of August 24, 2021, the rectorates have applied a strengthened control of the motivation and educational project, and recent administrative jurisprudence penalizes files deemed too generic. Training in the legal framework and in constructing a solid motivation is no longer optional for families aiming for home education.

Recent IEF Jurisprudence: What Administrative Courts Require in the File

The rulings issued by several administrative courts between 2023 and 2026 outline a clear line. A standardized educational project, copied from an online template, is no longer sufficient to obtain authorization for home education.

The judges check three specific points:

  • The child’s specific situation must be documented with individualized pieces (medical assessments, school reports, previous inspection reports if applicable).
  • The pedagogical capacity of the parents must be demonstrated through a training background, concrete experiences, or detailed pedagogical methods, not by a simple statement of intent.
  • The administration cannot require that schooling be impossible. It must compare the advantages and disadvantages for the child, which requires the applicant to provide usable comparative elements.

This jurisprudential analysis grid changes the very nature of the file. We observe that families who draft their motivation without knowing these criteria produce off-topic documents, focused on their educational beliefs rather than on the child’s situation.

IEF Motivation: Structuring an Educational Project that Withstands Scrutiny

Reason 4 of the law (the child’s specific situation motivating the educational project) is the most invoked and the most refused. The reason is technical: this reason requires a two-step demonstration, first the child’s situation, then the adequacy of the project.

Documenting the Child’s Situation

A solid file begins with factual pieces. The rectorates expect dated and signed elements: medical certificate if a disorder is invoked, speech or psychological assessment, correspondence from the current school, testimonials from health or education professionals.

Writing a motivation letter that mentions “discomfort” without supporting documents does not constitute a specific situation in the legal sense. The file must prove, not assert.

Describing the Pedagogical Method Precisely

The educational project must detail the materials used, the weekly schedule, the methods of evaluating learning outcomes, and the educational resources mobilized. We recommend mentioning the chosen reference textbooks or programs, complementary activities (sports, arts, community), and the planned socialization methods.

A project that remains at the level of intentions (“we wish to respect the child’s pace”) will be dismissed. The DASEN expects an operational document, comparable to an adapted school program.

Training in Home Education Law: Distinguishing Reliable Sources

The regulatory framework of IEF is based on the law of August 24, 2021, and its implementing decrees, but also on the decisions of the Constitutional Council and on constantly evolving administrative jurisprudence. Popular articles are not enough to build a compliant file.

A useful training covers at least three axes:

  • The analysis of the legal grounds for authorization and their actual application conditions, not just their statement.
  • The reading of recent administrative court decisions, which clarify what the law text leaves vague (expected level of proof, admissible documents, deadlines for appeals).
  • The preparation for annual pedagogical inspections conducted by the academic inspection, whose framework differs significantly between academies.

Trainings provided by lawyers specialized in education law or by recognized associations in the field of IEF offer an updated reading of the law. Content written before 2021 is largely obsolete regarding authorization.

IEF Pedagogical Control: Anticipating the Academic Inspection

The annual inspection by the academic authority focuses on the child’s progress and the conformity of the education to the expectations of the common core. The family must demonstrate that the child is progressing, not that they reach the same level as a student of the same age.

This nuance is often misunderstood. The reference is the child’s individual progress, measured from one inspection to another. Inspectors evaluate the gradual mastery of the competencies of the common core of knowledge, skills, and culture.

Preparing a structured learning portfolio (dated work, assessments, written productions, reading logs) significantly facilitates the inspection process. Families who arrive without written evidence of learning expose themselves to a formal notice of schooling.

Managing an Unfavorable Inspection

In case of an insufficient result, a second inspection is organized. If this confirms the shortcomings, the DASEN can require the parents to enroll the child in a school. The appeal period is short. Knowing the procedure before it starts radically changes the family’s ability to react.

The law of home education is not limited to obtaining the initial authorization. It involves an annual cycle of documentary and pedagogical obligations. Families who invest in serious legal training and in the methodical construction of their educational project significantly reduce the risk of refusal or withdrawal of authorization. It is a substantive work, not an administrative formality.
